New York Acceptance Status for VirtualOpacity® — EPA ALT-152A

New York Visible Emissions / Opacity Standard
The opacity limit for New York is 20% opacity (6-min avg) general, except one continuous 6-min period per hour of not more than 57%; process sources 20%/6-min (uncombined water exempt); stationary combustion 20% with one 6-min period per hour <=27%, as established under 6 NYCRR 211.2 (general); 212-1.6(a) (process sources); 227-1.4(a) (stationary combustion).
Compliance is demonstrated via EPA Method 9 (40 CFR Part 60, Appendix A); NYSDEC observer certification required.
Averaging period: 6-minute average
New York's 57% opacity exception period is among the highest nationally — most states cap exceptions at 40–60%. NYSDEC Chapter 40 visible emissions requirements are applied statewide. New York City has its own local air pollution control provisions under the NYC Administrative Code.
